Re: Unlawful Removal of Smoke / Carbon monoxide Detectors
Please advised if the smoke/carbon monoxide detector and any other NYC mandated device installed within your apartment has been removed or is not in working condition. This constitutes a serious violation of both New York City law and the term of your Proprietary Lease with Georgetown Mews Corporation
The detector should be placed in the hallway or ceiling outside of the bedroom area.
Pursuant to New York City housing Maintenance Code §27-2045, all dwelling units are required to have functiononig smoke detectors installed and always maintained.
Additionally, the Proprietary Lease explicitly requires shareholders to maintain their apartments in compliance with all applicable laws and safety codes. The removal of a smoke detector is not only dangerous, but also unlawful, placing the health and safety of all residents in jeopardy.
Failure to maintain the smoke/carbon monoxide detector will subject you ro a 1st offense fine of $1,000, 2nd offense $2,500. and 3rd offense $5,000 fine and legal action of potential liability for any resulting damage or injuries.
